Website www.goldfish.hr is a web store that sells products and services, and operates under the ownership of the company VNF22 doo, Mlinovi 120 H, 10 000 Zagreb, Croatia, entered in the commercial register of the Commercial Court in Zagreb under number Tt-24/41379-2 of 26.10.2024, OIB: 79916603411, MB: 6027253, account with Privredna banka Zagreb IBAN: HR652340009111130245, contact phone 098 1605275.

To the conditions of business and use of the site www.goldfish.hr and the conclusion of distance contracts via means of further communication, the Terms of Use stated here shall apply primarily, unless the contracting parties (Seller and Buyer) agree otherwise.

The terms of business and use are subject to the Electronic Commerce Act (Official Gazette 173/03, 67/08, 36/09, 130/11, 30/14, 32/19), the Consumer Protection Act (Official Gazette 19/22, 59/23) and the Civil Obligations Act (Official Gazette 35/5, Official Gazette 41/08 and 125/111 and 78/15, 29/18, 126/21, 114/22, 156/22, 155/23).

GENERAL TERMS AND CONDITIONS

Access to and use of the goldfish.hr website and services are subject to these Terms of Use of the website and services (hereinafter referred to as: Terms of Use) and all applicable laws and other legal regulations. By accessing this website, you are deemed to have read, understood and fully accepted these Terms of Use. If you do not accept these Terms of Use, please do not use the website. www.goldfish.hr. Goldfish.hr reserves the right to revise the Terms of Use at any time and to terminate access to this site without prior notice. It is your obligation to periodically re-read the Terms of Use to familiarize yourself with any changes. Using the site after the Terms of Use have been changed will imply that you are familiar with the changes and that you understand and fully accept them. We exclude liability for any damage caused to users or third parties as a result of such changes.

COPYRIGHT

The site claims copyright on all its own content (textual, visual and audio materials, databases and program code). Unauthorized copying of any part of the site, without the permission of the copyright owner, is considered a violation of the rights of a third party and is subject to prosecution. 

RIGHT TO CHANGE CONTENT AND SERVICE

The editorial staff of the site reserves the right to change, cancel (temporary and permanent) any content or service on the site without prior notice.

ORDER ON THE WEBSITE

* Product orders are made electronically. By clicking on the "Add to cart" icon, the selected product is saved in the shopping cart, which you can find at the top of the page on the right. Check the products you want to order in the basket. If you want to remove a product from the basket, click on "-" or click on "+" to add.

Then you need to fill in your personal information, enter your delivery address and select your preferred payment method. If you need an R-1 invoice, select the 'Legal entity' box and enter the company name, address and OIB required for issuing an R1 invoice.

After you check the 'Accept terms and conditions' box, you confirm that you are familiar with these terms of use and that you agree to the obligation to pay for the product.

The goods are considered purchased at the moment the buyer confirms the order and pays the bill.

* You will receive confirmation that your order has been received by Goldfish.hr at the email address you used to register as a customer.

* We will deliver the ordered products to you as soon as possible. If you have any questions about your order, contact us by e-mail at goldfish@goldfish.hr or call us at 098/ 1605275.

* If Goldfish.hr is unable to deliver any of the ordered products, we will contact the user via e-mail and inform them of the above.

USER OBLIGATIONS

Site users are strictly prohibited from:

* publishing, sending and exchanging content that violates existing Croatian and/or international laws, content that is offensive, vulgar, threatening, racist or chauvinistic and harmful in any other way;

* publishing, sending and exchanging information that the visitor knows or assumes is false, and whose use could cause harm to other users;

* false representation, i.e. representation on behalf of another legal or natural person;

* manipulation of identifiers in order to disguise the origin of the content published or sent through the portal services;

* publishing, sending and exchanging content that is protected by copyright;

* publishing, sending and exchanging unwanted content to users without their consent or request, or through deception;

* knowingly publishing, sending and exchanging content that contains viruses or similar computer files or programs designed to destroy or limit the operation of any computer software and/or hardware and telecommunications equipment;

* collecting, storing and publishing personal data of other portal visitors and users,

* publishing advertising messages - it is considered that by publishing an advertising message, an order for a sponsored article has been placed according to the site's valid price list and that the person/company that wrote such a post is willing to pay for it.

TERMS OF SALE

These Terms, as well as certain terms of sale indicated with information about certain products, represent an offer to conclude a Contract, and the user accepts them by concluding an order or in another manner specified in these Terms, which is considered to be a contract concluded between the user and Goldfish.hr, according to the terms of sale specified in these Terms.

The subject and commercial purpose of the Contract is the purchase of a selected product or service via the Internet store with the payment of the appropriate fee - the price of that product or service. The Contract is concluded by means of further communication (Distance Contract) via: the Internet and telephone with and without human intervention.

In the case of distance contracts, the notification from Article 60 of the Consumer Protection Act must be adapted to the means of remote communication used and must be communicated in simple and understandable language, and if it is given on a permanent medium, it must also be legible.

If the contract is concluded through a means of remote communication that allows a limited space or a limited time to display the notice, the trader is obliged to inform the consumer at least of the information from Article 60 of the Consumer Protection Act through that means of remote communication.

PRICES OF PRODUCTS AND SERVICES VIA THE WEBSHOP SERVICE

The prices of products and services displayed on the Website are expressed in euros (“EUR”). Product prices do not include delivery costs. Prices, payment terms and special offers are valid only at the time of order and/or payment and are subject to change without prior notice.

By confirming the purchase, users complete the purchase process via the web shop service. The purchase agreement is concluded at the moment of selecting to agree to the Terms of Business and confirming that the customer understands the payment obligation.

DELIVERY AND SHIPPING TERMS

Delivery price list:

  • Home delivery by GLS courier service: EUR 4.00
  • Delivery to GLS Parcel Shop: 3.50 EUR
  • Delivery to GLS parcel locker: 1.70 eur
  • Express delivery same day for orders received by 12:00: 7.00 eur

DELIVERY OF GOODS

We deliver ordered items by courier or by our own delivery. Delivery will take place within 1-5 business days from the date of order, and no later than within the legally prescribed period of 30 days. If it is impossible to deliver the selected product due to the product not being in stock, we are obliged to inform the buyer in writing, and the buyer has the right to cancel the order/contract or agree to a later delivery date. We will try to deliver all ordered items as soon as possible. With prior agreement with Godfish.hr, the buyer can personally pick up the ordered product at the company's headquarters at Mlinovi 120 H, 10 000 Zagreb on weekdays from 9 a.m. to 4 p.m., in which case there is no delivery cost.

PRODUCT COMPLAINTS

Please attach the receipt as proof of purchase to the complaint.

A material defect exists if the thing does not have the necessary properties for its regular use and handling.

The seller is liable for material defects of the goods that they had at the time of the transfer of risk to the buyer, regardless of whether he was aware of them, and for those material defects that appear after the transfer of risk to the buyer if they are a consequence of a cause that existed before that.

The seller is not liable for defects if they were known to the buyer or could not have remained unknown to him at the time of concluding the contract. It is considered that those defects could not have remained unknown to the buyer that a careful person with average knowledge and experience of a person of the same profession and profession as the buyer could easily notice during a normal inspection of the goods.

The buyer has the right to complain to the seller about the existence of material defects in the product within 2 years from the date of purchase in accordance with the Obligations Act. The existence of material defects - hidden defects can also be proven by expert examination. In the event of material defects in the product, the consumer may request that the defect be removed, that another item be handed over, that the price be reduced or he may declare that he wishes to terminate the contract. If the defect is insignificant, the buyer does not have the right to terminate the contract, but he is entitled to other rights from liability for material defects, including the right to repair the damage. The costs of removing the defect and handing over another item without defects are borne by the seller. The ordered products are packaged in such a way that they are not damaged by normal handling during transport/delivery. The buyer is obliged to inspect the packaging of the shipment upon receipt. If the packaging of the shipment has visible damage/defects, we recommend that the buyer refuse to accept it, because there is a possibility that the product inside such packaging is damaged. By refusing receipt, the delivery service will return the shipment to Goldfish.hr, noting that the shipment contains a defect.

In the event of a product complaint due to shortages or hidden defects, please send the product to VNF22 doo, Mlinovi 120 H, 10 000 Zagreb, Croatia, or contact us at 098/ 1605275.

In the event that you order goods and refuse to receive them without reason (the packaging is not damaged), Goldfish.hr reserves the right to withhold from the paid amount of the purchase price the amount of the direct costs of returning the product.

RETURN (EXCHANGE) AND COMPLAINT TERMS

The buyer has the right to return or exchange the product in the following cases:

* if goods that were not ordered were delivered,

* if goods were delivered that had a manufacturing defect,

* if there is damage to the products

NOTICE ON THE METHOD OF WRITTEN CONSUMER COMPLAINTS

All complaints pursuant to Article 10 of the Consumer Protection Act can be submitted by post or email, as well as at the business premises you are in. If the complaint is submitted at the business premises, the trader is obliged to immediately certify a copy of it in writing.

In order to be able to immediately confirm receipt of your written complaint, and then respond to it, in accordance with Article 10, Paragraph 3 of the Consumer Protection Act, please provide accurate information for receipt.

We are legally required to respond to your complaint in writing no later than 15 days from the date of receipt of the written complaint. Otherwise, you can contact the consumer protection inspectorate or the Consumer Protection Association.

European Commission Regulation no. 524/2013 on online resolution of consumer disputes, which has been in force since January 9, 2016, the Platform for Online Resolution of Consumer Disputes (Platform for ORS) was put into operation.

In the event of a dispute between the Buyer and the Seller, a complaint may be filed with the Court of Honor of the Croatian Chamber of Economy. The procedure before the Court of Honor is conducted in accordance with the Regulations on the Court of Honor of the Croatian Chamber of Economy, which stipulate that the members of the council of that court, in addition to independent legal experts and representatives of traders, also include consumer representatives.

SAFETY STATEMENT

Monri WSPay, as the executive of credit card authorization and collection, processes personal data in its capacity as a processor and processes personal data in accordance with the General Data Protection Regulation of the European Parliament and of the Council No. 2016/679 and the strict rules of the PCI DSS L1 regulation on the protection of data entry and transmission.

Monri WSPay uses an SSL certificate of 256-bit encryption and TLS 1.2 cryptographic protocol as the highest level of protection when registering and transferring data.

Personal data used for the purpose of authorization and billing, i.e. in the performance of obligations from the Agreement or based on the Agreement, are considered confidential data.

The following personal data of the customer are required for the execution of the Agreement (authorization and payment):

Monri WSPay does not process or use this personal data except for the purposes of executing the authorization contract and billing.

Monri WSPay guarantees compliance with all conditions set forth in applicable personal data protection regulations for processors of personal data, and in particular, taking all necessary technical, organizational and security measures, which is particularly confirmed by the PCI DSS L1 certificate.

STATEMENT ON THE PROTECTION OF PERSONAL DATA COLLECTION AND ITS USE

Goldfish.hr is committed to protecting the personal data of its customers by collecting only the necessary, basic data about customers/users that are necessary to fulfill our obligations; informing customers about the use of the collected data; regularly giving customers the opportunity to choose how their data is used, including the opportunity to decide whether or not they want their name to be removed from lists used for marketing campaigns. All user data is strictly kept and is only accessible to employees who need this data to perform their job. All employees of Goldfish.hr and business partners are responsible for respecting the principles of privacy protection.

We guarantee that we will not make your e-mail address and other data available to third parties, legal entities and individuals, without your consent, as this is against our privacy policy.

We ask for your special permission if you want us to contact you about special offers and promotions. Inspection by authorized services of the executive state power of the Republic of Croatia, for the purposes of investigative actions based on a valid court order, is excluded from the above.

Goldfish.hr is not liable for accidental errors or errors due to force majeure, or other objective circumstances that cause an accidental violation of the guaranteed protection of your data, but guarantees that the error will be corrected, if possible, as soon as possible.

GDPR – Notice to customers about their rights under the Personal Data Protection Act

Dear customers,
We hereby inform you that we care about your privacy and will process your personal data solely for the purpose of processing your orders/requests/complaints/compliments, all in accordance with Article 11 of the Consumer Protection Act. 
The company VNF22 doo, Mlinovi 120 H, 10 000 Zagreb, Croatia, will process your data – the data controller Vlatka Nad Frgačić, who acts in accordance with all applicable legal regulations. In the event that you do not wish to provide your personal data, we will unfortunately not be able to process your inquiries and requests. Your data will be kept for as long as legally required. Your data will be shared exclusively with business entities (such as delivery services, accounting services, fiscalization, card payment intermediaries and banks) that are necessary to perform the service to you and legal regulations.

Your rights to protect personal data are as follows: 

– obtain confirmation whether your personal data is being processed and access to the personal data being processed;
– supplement, modify and correct personal data;
– obtain the deletion of personal data or request that the data be made anonymous;
– block unlawful data processing and restrict processing;
– object to processing based on legitimate interest;

In case you wish to exercise any of your legal rights, you can contact us with your request at the e-mail address goldfish@goldfish.hrIf we do not respond to your request to change your personal data within 15 days, you have the right to file a complaint regarding the processing of your personal data with the Data Protection Agency. 

Termination of contract

In accordance with Article 79 of the Consumer Protection Act, you are entitled to unilaterally terminate the contract without giving any reason within 14 days from the date of delivery of the product. You can exchange the product you are dissatisfied with for a new one or return it for a refund within 14 days of receiving the product at your address.

In order to exercise the right to unilaterally terminate this Agreement, you must inform us of your decision to unilaterally terminate the Agreement before the expiry of the deadline by an unequivocal statement sent by post to the address VNF22 doo, Mlinovi 120 H, 10 000 Zagreb, Croatia or by e-mail to the address goldfish@goldfish.hr, in which you will state your name and surname, address, telephone number, fax number or email address.

We will provide you with confirmation of receipt of the notice of unilateral termination of the contract, without delay, by e-mail or fax.

The deadline for unilateral termination is 14 days from the day on which you or a third party designated by you, who is not the carrier, have been given possession of the goods that are the subject of the contract.

If you unilaterally terminate this Agreement, we will refund the money we received from you, including delivery costs, without delay, and no later than within 14 days from the day we received your decision to unilaterally terminate the contract, unless you have chosen another type of delivery that is not the cheapest standard delivery that we have offered, the refund will be made in the same way you made the payment.

The refund will be made in the same way you made the payment. In the event that you agree to another way of returning the amount paid, you do not bear any costs in relation to the return. We can issue a refund only after the goods have been returned to us or after you provide us with proof that you sent the goods back to us.

Return the goods by post or hand them over to our registered office at VNF22 doo, Mlinovi 120 H, 10 000 Zagreb, Croatia, without undue delay, and in any case no later than 14 days from the day you communicated your decision to unilaterally terminate the contract to us. You are deemed to have fulfilled your obligation on time if you send or hand over the goods to us, or to a person authorized by us to receive the goods, before the expiry of the aforementioned deadline.

You are responsible for any reduction in the value of the goods resulting from the handling* of the goods, except that which was necessary to determine the nature, characteristics and functionality of the goods.

  • Handling/using the product is considered the consumption and use of the product/service that reduces the value of the product/service.
